A MODEL OF ISLAMIC LAW RESEARCH

Abstrak

This paper examines the fiqih research as a role model of Islamic legal research based on the discourse of the emergence of u??l fiqh as the method of ijtihad has a significant role in the research and development of Islamic law. As a methodology, u??l fiqh has evolved along with the times. In fact, u??l fiqh has different characteristics between schools. This research  describes the role of u??l fiqh in the discovery and formation of Islamic law. Through this paper described starting from the definition, history of development, the object of study and at a glance about the flow of u??l fiqh. In addition, this research also describes the model and typology of u??l fiqh research. The approach used in the discussion of this research is the historical approach, by describing the development of u??l fiqh based on the period. Based on this study it can be seen that as a method of legal discovery, the proposed fiqih is part of Islamic legal research methods in general. The study of Islamic law as a whole is divided into two major areas, namely the study of descriptive Islamic law and prescriptive Islamic legal research. Islamic legal research descriptive telescoped Islamic law as a social phenomenon that interacts with social phenomena.
